1. Provider
These terms apply to the purchase and use of the software product "FlexViu", offered by:

2. Subject of the Agreement
FlexViu is a digital software product designed to enhance website usability through optional visual and functional adjustments.
Use is provided under a recurring licence (subscription).
Upon subscribing, the customer receives the right to use FlexViu for the agreed term in accordance with these terms.
3. Licence Model and Term
3.1 FlexViu is offered as a recurring licence (monthly or annually, as specified).
3.2 The subscription begins upon conclusion of the agreement or delivery of the product.
3.3 Unless otherwise agreed, the subscription renews automatically for the selected term unless cancelled before the end of the current period.
3.4 Cancellations must be submitted in writing or through the provided cancellation mechanism.
4. Prices and Payment
4.1 Licence fees are due in advance for the respective subscription period.
4.2 All prices are in CHF unless otherwise stated. Statutory VAT is shown where applicable.
4.3 In the event of payment default, Meyer Digital is entitled to suspend access to FlexViu or to terminate the contractual relationship with immediate effect.
5. Usage Rights
5.1 Upon payment of the licence fee, the customer receives a non-exclusive, non-transferable right of use limited to the contract term.
5.2 The licence applies exclusively to the agreed domain or project.
5.3 Redistribution, sublicensing, or use beyond the agreed scope is not permitted.
6. Purpose and Legal Disclaimer
FlexViu is designed to improve user comfort and individual customisability of a website.
FlexViu is not a legal compliance solution.
In particular:
- Its use does not replace any legal accessibility requirements.
- No conformity with national or international accessibility standards is guaranteed (e.g. WCAG or comparable standards).
- Meyer Digital does not provide legal advice.
- Responsibility for legally compliant implementation of accessibility lies solely with the website operator.
FlexViu is a supplementary comfort tool, not a certification or auditing mechanism.
7. Availability and Development
7.1 Meyer Digital reserves the right to further develop FlexViu or adjust features, provided the essential purpose of the contract is not impaired.
7.2 Permanent and uninterrupted availability is not guaranteed.
8. Liability
To the extent permitted by law, Meyer Digital is only liable for damages caused by intentional or grossly negligent conduct.
Liability is excluded for:
- indirect or consequential damages
- loss of profit
- data loss
- third-party claims related to missing accessibility conformity
- legal consequences arising from the customer's non-compliance with statutory requirements
9. Termination
9.1 After cancellation, usage rights end at the expiry of the paid period.
9.2 After contract termination, FlexViu must be removed from the website.
10. Governing Law and Jurisdiction
Swiss law applies exclusively.
The place of jurisdiction is Zurich, Switzerland, unless mandatory legal provisions dictate otherwise.
